Updated List of State Packaging and Labeling Requirements

With the provisional rules for Adult-Use Marijuana coming into effect this September, it's a good idea to be aware of the new requirements for labels and packaging.

The State of Maine has different requirements for medical and adult-use marijuana products. As the law is currently written, a farm cannot produce marijuana for both medicinal and adult-use purposes. Below is a list of the most up to date requirements for medicinal and adult-use marijuana packaging and labels.


Medical Marijuana [Title 22. Chapter 558-C. §2429-A]

  • Packaging

    • Requirements

      • Must be child-resistant and tamper-evident

      • Opaque (non-transparent) packaging

      • Signifier that the package contains harvested marijuana or a marijuana based product

      • If a multi-serving liquid the container must have a child-resistant cap and an integral measurement component.

      • Conforms with all other applicable requirements and restrictions.

    • Prohibitions

      • No Violations of federal trademark law or regulations

      • Not Designed to appeal particularly to persons under 21 years of age

      • No Removal or obscuring of identifying information

      • No False or deceptive labels

      • No Violations of any other applicable packaging requirements or rules

  • Labels

    • Requirements

      • If a label is made with any information regarding contaminants, cannabinoid potency or profile, or any other tested data then the label must be verified by a marijuana testing facility. This can be done by including a QR code leading to the product’s test results.


Adult-Use Marijuana [Title 28-B. Chapter 1: Sub 7. §701, §702]

  • Packaging

    • Requirements

      • Product must either be pre-packaged in opaque (non-transparent) packaging that is child-resistant and tamper-evident; or be placed in opaque packaging that is child-resistant and tamper-evident at the final point of sale to a consumer

      • Signifier that the package contains harvested marijuana or a marijuana based product

      • If a multi-serving liquid the container must have a child-resistant cap and an integral measurement component.

      • Conforms with all other applicable requirements and restrictions.

    • Prohibitions

      • No Violations of federal trademark law or regulations

      • Not Designed to appeal particularly to persons under 21 years of age

      • No Depictions of a human, animal or fruit on the packaging

      • No Removal or obscuring of identifying information

      • No False or deceptive labels

      • No Violations of any other applicable packaging requirements or rules

  • Labels

    • Requirements

      • License Numbers of the Following (when applicable):

      • Cultivation Facility

      • Manufacturing Facility

      • Marijuana Store

      • Testing Facility

      • Batch Number

      • Net Weight

      • Cannabinoid Potency

      • Amount of THC or other cannabinoids per serving

      • Universal Symbol for THC Content (if needed)

      • For Tinctures, Edibles, and Concentrates

        • List of gases, solvents, and chemicals used for extraction

        • Amount of marijuana concentrate per serving as measured in grams

        • Amount of marijuana concentrate per package of the product as measured in grams

        • Usage Instructions

        • List of ingredients and possible allergens

        • A recommended use-by or expiration date

    • Prohibitions

      • Not Designed to appeal particularly to persons under 21 years of age

      • No Imitations of candy advertising, including the term “candy” or “candies”

      • No Depictions of a human, animal or fruit on the label

      • No Claims of curative or therapeutic effects, including any health or physical benefit claims

      • No Encouragement of excessive or rapid consumption

      • No Removal or obscuring of identifying information

      • No False or deceptive labels

      • No Violations of any other applicable labeling requirements or rules

    • Approved but Not Required Labeling and Packaging

      • A statement of compatibility with dietary practices

      • Depictions of geometric shapes or marijuana leaves

      • Use of the terms "organic," "organically cultivated" or "organically grown" in accordance with requirements regarding the use of such terms

      • Any other information that has been preapproved by the department.
